TERMS AND CONDITIONS
1.1 All payments should be made by credit card via our online invoicing system.
1.2 The Client shall pay to MYDRAFTING of Amores Design Pty Ltd. fees and reimbursable expenses for design services as set forth herein. A deposit fee is required to be paid before starting the work on the project. For the remaining balance, invoices will be sent after every design stage progress as follows: Preliminary Stage, D.A Stage, B.A. /CC Stage, and Tender Stage.
1.3 All preliminary drawings will be issued with a progress stamp. Final drawings and CAD (dwg.) files will only be released once the final payment has been paid.
1.4 In the event that Amores Design Pty Ltd. invoices a company or other entity at the request of the Client, the Client shall remain primarily responsible for the payment of the Amores Design Pty Ltd. fees and shall not be able to plead by way of defense to any claim by the Designer to any other entity.
2.1 During the Preliminary stage, the Client is privileged to make up unlimited changes, but not the change of design brief example change of the number of bedrooms, or change of floor area of more than 20m2.
Preliminary drawings is consist of basic floor plans, conceptual 3D visual or 1-front elevation, and 1 section drawings.
2.2 After the approval of the preliminary design, D.A. and B.A./C.C. stage will be implemented at this stage client is only allowed to make technical revisions, any change of design brief is subject to new hourly rate fee as per Clause 6.1. Moreover, Amores Design will accommodate minor design and technical revisions to reflect building consultant’s drawings, and to meet Council’s comments and conditions free of charge.
2.3 If requested by client structural changes and other consultants design will be reflected in our drawing free of charge even after issuance of BA /CC drawings.
2.4 MYDRAFTING always aims to deliver the drawings on time, and produce high-quality drawings acceptable for Council lodgments and Construction. However, Amores Design doesn’t guarantee an error-free drawing and on-time delivery for some instance.
2.5 Finished drawings will be delivered in PDF and DWG, hard copy printing is not included in the quote.
3. Money Back Guarantee Policy
3.1 In the event that MYDRAFTING doesn’t meet the client’s needs during the preliminary stage of design, the Client may terminate the contract within the first 12 days from the date of placement of order during the preliminary stage. In which case, the Client will be refunded of his full deposit payment. The 14-Day Money-Back Guarantee is valid for online payments only. It is also valid only for Be The Rockstar/Online Designer Package. It does not apply to 3D visuals and all the other add-on services.
3.2 Approval Guaranteed* only applies to full compliant proposals. Any proposal which may be subject to development approval, planning permission, relaxation, or similar is not covered by this guaranteed.
4.1 Copyright in all drawings prepared by MYDRAFTING for the Client, will remain the property of client but MYDRAFTING of Amores Design Pty Ltd. reserved the right to use the drawing as a sample of work of the company.
4.2 MYDRAFTING assumes that the client has permission from the rightful owner to use any sketch, design, plan sample, data, and reports are provided by client for inclusion in the design, and will hold harmless, protect, and defend MYDRAFTING from any claimor suit arising from the use of such materials.
5.1 All monies payable by the Client to Amores Design Pty Ltd. shall be made at least seven days from the date of the invoice. Payment to be made using Credit Cards, or EFT to: ANZ Bank: AMORES DESIGN PTY LTD. (BSB-014704) 2526-81834.
5.2 The Building Designer is entitled to suspend provision of the services where the payment is outstanding for more than 10 working days until payment is made.
5.3 An Administration Fee will be charged at $30.00 per follow-up of unpaid invoices. All unpaid invoices will also attract a penalty rate of 3% per month until all monies have been paid.
6. Hourly Rates
6.1 If the MYDRAFTING services are increased due to an amendment of brief, then an additional fee shall be chargeable on a time basis as $60/hour for the Manager and $22/hour for the Draftsman (+GST). Any additional fees will be discussed with and approved by the Client prior to any amendments. Site meeting (optional) for Gold Coast area is $90.00, Brisbane area is $120.00 and Sydney area fee is $190.00.
6.2 If Building Design Services are provided prior to the acceptance of conditions of engagement, the Client agrees that those services shall, from the date of signing these conditions of engagement, be chargeable by the Designer to the Client at the rates set out in Clause 3.1.
7. Building Designer’s Duties
The Designer shall exercise the reasonable skill and care of a skilled Building Designer.
8. Consultant’s Duties
Where the Client engages secondary consultants, MYDRAFTING shall only be responsible for coordination and integration of their services.
9. Client’s Duties
The Client shall provide to MYDRAFTING a brief, and all information for the commission, including title description, affectations, boundaries, levels, and all services information.
10. Builder’s Duties
During the construction stage, the Builder (Construction Manager, Contactor, or otherwise) is, amongst other tasks, responsible for job safety, supervision of work, quality assurance certifications, construction methods, means, sequences, procedures, techniques, and scheduling. Any errors found in the plan must be first report to the building designers for resolution before proceed any work.
11. Contract Administration
11.1 Where MYDRAFTING. Services do not include Contract Administration, MYDRAFTING is not obliged to answer questions or to visit the site after completion of the design services, but should the Building Designer agree to do so, payment will be on a time charge basis as set forth herein. Any advice or visit is confined to only those matters for which the advice or visit is specifically requested, and the Building Designer undertakes no responsibility for any other matters or aspects of the work regardless of how obvious at the site or vital to the site at the time of the visit.
12. Taxation Law
In accordance with taxation law, a 10% good and services tax will be added to all fees.
13.1 If the Client becomes insolvent or enters into a scheme of arrangement with its creditors or fails to pay MYDRAFTING of Amores Design Pty Ltd. in accordance with this agreement, the Building Designer may terminate this agreement forthwith by written notice addressed to the Client.
13.2 In any other case either party may terminate this agreement on the expiration of at least 30 days’ written notice. Upon termination the Client shall pay Amores Design all amounts payable pursuant to this agreement in accordance with the provision of Clause 11.3.
13.3 If Building Design Services are terminated during the course of any stage of the work for which a fee has been agreed, Amores Design Pty Ltd. shall be entitled and the Client shall pay the Building Designer on a pro rata basis for the work done by the Designer to the date of termination.
